AGEMARK 2020 MADRID S.L. (hereinafter referred to as “the Entity”) is the owner of this website portal (hereinafter referred to as “the Portal”). Its registered office is located at Paseo de la Habana 3, 28036, MADRID, and its NIF is B01958370. The contact email address is [email protected].

The domain name through which you have accessed the Portal is owned by the Entity. This domain name may not be used in connection with any content, products, or services that are not owned by the Entity or in any way that could cause confusion among end users or discredit the Entity.

Purpose

This Legal Notice outlines the terms of use that govern access to, navigation of, and use of the Portal, as well as the responsibilities arising from the use, provision, and/or contracting of any products or services that may be offered, as well as the content it contains. This is without prejudice to the fact that the Entity may establish specific conditions that regulate the use, provision, and/or contracting of products or services that may be offered through the Portal.

Merely accessing the Portal, filling out forms, sending requests for information, inquiries, complaints, submitting offers for contracting, and generally any act of a similar nature carried out through the forms, electronic mailboxes, or other contact methods available on the Portal implies that those navigating the Portal acquire the status of User and accept without reservation all the rules included in this Legal Notice.

Consequently, every User must read and understand the content of this Legal Notice carefully.

If any products or services are offered through the Portal, the fact that they are used and/or requested by the User will also imply acceptance without reservation of the particular conditions that may have been established for this purpose, which will form an integral part of this Legal Notice.

Access and Use of the Portal

Access to the Portal by Users is free and unrestricted. However, the use, provision, and/or contracting of any products or services that may be offered by the Entity may be subject to prior compliance with formal requirements such as completing the corresponding form, payment of fees or charges, and/or prior acceptance of the applicable specific conditions.

Merely accessing the Portal does not imply the establishment of any type of commercial relationship between the Entity and the User unless the appropriate means have been established for that purpose and the User has fulfilled the requirements set forth.

The inclusion of information about products or services offered by the Entity in the Portal is solely for informational and advertising purposes unless explicitly stated otherwise.

 

If the User is required to register to use, provide, or contract any product or service offered through the Portal, they are responsible for providing truthful and lawful information, guaranteeing the authenticity of all data entered while filling out the preset forms to access the relevant products or services.

If, as a result of registration, the User must use a password, they agree to use it diligently and maintain its confidentiality.

Consequently, Users are responsible for the appropriate custody and confidentiality of any identifiers and/or passwords provided by the Entity, and they agree not to transfer their use to third parties, whether temporarily or permanently, nor to allow their use by unauthorized persons.

The User shall be solely responsible for the use and/or contracting of the products or services offered on the Portal by any third party who illegitimately uses a password or identifier supplied to the User due to negligent actions or loss of the same by the User.

In light of the above, it is the User’s obligation to immediately notify the Entity of any event that allows the misuse of identifiers and/or passwords, such as theft, loss, or unauthorized access by third parties, in order to proceed with their immediate cancellation.

Until such events are communicated, the Entity shall be exempt from any responsibility that may arise from the misuse of identifiers or passwords by unauthorized third parties.

In any case, access, navigation, and use of the Portal, and where applicable, the use or contracting of services or products offered through it, is done under the sole and exclusive responsibility of the User, who agrees to diligently and faithfully observe any additional instructions given by the Entity or authorized personnel regarding the use of the Portal and its contents.

Therefore, the User is obliged to use the contents, products, and services diligently, correctly, and lawfully, in accordance with current legislation, and in particular, agrees to refrain from:

  • (I) Using them for purposes or effects contrary to the law, morality, generally accepted good customs, or public order, and the instructions received from the Entity.
  • (II) Using them for purposes harmful to the legitimate rights of third parties.
  • (III) Employing the contents and products, and in particular, any type of information obtained through the Portal or services to send advertising, communications for direct sales, or any other commercial purpose, unsolicited messages addressed to a plurality of people regardless of their purpose, as well as refraining from marketing or disseminating such information in any way.

Responsibilities and Limitations

The Entity cannot guarantee the reliability, usefulness, or accuracy of the information provided through the Portal. In particular, the Entity does not guarantee or assume responsibility for:

 

  • (I) The continuity of the Portal’s contents and/or the lack of availability or accessibility of the Portal or its technical continuity;
  • (II) The absence of errors in such contents or products;
  • (III) The absence of viruses and other harmful components in the Portal or the server that provides it;
  • (IV) The invulnerability of the Portal and/or the impenetrability of the security measures adopted in it;
  • (V) If applicable, the lack of usefulness or performance of the contents or services of the Portal;
  • (VI) The damages or injuries caused, to itself or to a third party, by any person who violates the conditions, rules, and instructions established by the Entity in the Portal or through the violation of its security systems;
  • (VII) Any other damages that may be caused due to inherent reasons related to the malfunctioning or defective operation of the Portal or the websites to which links may have been established.

However, the Entity declares that it has taken all necessary measures, within its capabilities and the state of technology, to ensure the operation of the Portal and prevent the existence and/or transmission of viruses and other harmful components to Users.

The Entity makes every effort to avoid errors in the contents published on the Portal. All contents offered through the Portal are kept up to date, reserving the Entity the right to modify them at any time.

The Entity is not responsible for the consequences that may arise from errors in contents that may appear on the Portal provided by third parties.

Any communication or transmission of content that infringes the rights of third parties and whose content is threatening, obscene, defamatory, pornographic, xenophobic, detrimental to the dignity of the person or the rights of children, in violation of current legislation, or any conduct that incites or constitutes a criminal offense is prohibited.

Likewise, the inclusion and communication of content by Users that is false or inaccurate and may induce or lead to error for the rest of the Users or the personnel of the Entity, particularly content protected by any intellectual, industrial, or image rights belonging to third parties, when it leads to a violation of current legislation, lacks authorization from the rights holder, undermines or discredits the fame or credit of the Entity, is considered an instance of illegal, misleading, or unfair advertising, and/or incorporates viruses or any other electronic elements that could damage or prevent the operation of the website, the network, the Entity’s computer equipment, or that of third parties, and/or access to the Portal by the rest of the users is prohibited.

The Entity may prohibit access to the Portal for any User who engages in any of the aforementioned behaviors, in a non-exhaustive manner.

Intellectual and Industrial Property Rights

The Entity is the owner or has obtained the corresponding license on the exploitation rights in matters of intellectual, industrial, and image property concerning the contents available through the Portal, including, but not limited to, texts, graphic designs, drawings, codes, software, photographs, videos, sounds, databases, indexes, images, brands, logos, expressions, and information, and in general, any other creation protected by national norms and international treaties on intellectual and industrial property (hereinafter referred to as “the Contents”).

All intellectual and industrial property rights regarding the Contents are reserved, and, in particular, it is prohibited to modify, copy, reproduce, publicly communicate, transform, or distribute in any way the totality or part of the Contents included in the Portal for public or commercial purposes, without prior, express, and written authorization from the Entity or, where applicable, the rights holder.

Access to and navigation by the User through the Portal in no case shall be understood as a waiver, transfer, license, or total or partial assignment of the aforementioned rights by the Entity.

Consequently, it is not permitted to remove, evade, or manipulate the copyright notice (copyright) and any other identification data of the rights of the Entity or its holders, incorporated into the contents, as well as technical protection devices, digital fingerprints, or any information and/or identification mechanisms contained therein.

 

References to names and registered trademarks, logos, or other distinguishing signs, whether owned by the Entity or third parties, imply a prohibition on their use without prior, express, and written consent from the Entity or its legitimate holders.

Under no circumstances, unless expressly stated otherwise, does access or use of the Portal and/or its Contents confer any rights on the User over the trademarks, logos, and/or distinguishing signs incorporated therein.

6.1 Links from the Portal to other web pages

The Entity may provide links, directly or indirectly, to resources or web pages on the Internet that are outside the Portal. The presence of these links on the Portal serves an informational purpose and does not constitute an invitation to contract products and/or services offered or that may be offered on the destination web pages, nor does it imply the existence of a commercial relationship or dependence with the entity that owns the linked web page. In these cases, the Entity will not be responsible for establishing the general and specific conditions to be considered in the use, provision, or contracting of these services by third parties and, therefore, cannot be considered responsible for them.

The Entity does not have the authority or human or technical means to know, control, or approve all the information, content, products, or services provided by other web pages to which links may be established from the Portal. Consequently, the Entity cannot assume any responsibility for any aspect related to the web pages to which a link may be established from the Portal, specifically, by way of illustration and not limitation, regarding their operation, access, data, information, files, quality and reliability of their products and services, their own links, and/or any of their contents, in general.

However, if the Entity becomes aware that the activity or information referred to by such links is illegal, constitutes a crime, or may harm the property or rights of a third party, it will act with the necessary diligence to remove or disable the corresponding link as quickly as possible. 6.2 Links from other web pages to the Portal

If any User, entity, or web page wishes to establish any type of link to the Portal, the following requirements must be observed:

  • (I) Prior, express, and written authorization from the Entity must be obtained.
  • (II) The link may only be directed to the main page of the Portal, unless otherwise expressly authorized.
  • (III) The link must be absolute and complete, meaning it must take the User, with one click, to the main page and must completely cover the entire screen of the main page of the Portal. In no case, unless the Entity authorizes otherwise, may the web page from which the link is made reproduce, in any way, the Portal, include it as part of its website or within one of its frames, or create a browser over any of the pages of the Portal.
  • (IV) On the web page from which the link is established, it may not be stated in any way that the Entity has authorized such a link, unless this is true. If the entity that creates the link from its web page to the Portal wishes to include the brand, name, trade name, sign, logo, or any other identifying mark of the Entity and/or the Portal, it must first obtain the prior, express, and written authorization of the Entity.
  • (V) In any case, the Entity prohibits the establishment of a link to the Portal from those web pages that contain materials, information, or content that are illegal, degrading, obscene, or, in general, that contravene morals, public order, current legislation, generally accepted social norms, or that infringe on legitimate rights of third parties.
